Benefit from A Return to Work Policy and ongoing communication

Establishing early and ongoing communication with your injured employee is a valuable cost saving tool.

If a worker is to be out of work for a period of time, let them know you want to be in contact at least once a week with the goal of getting back to work as soon as possible.

If you don’t hear from your injured employee; call them to inquire as to how they are feeling, the progress of their medical treatment, and if they have a return to work date from their physician.

Your telephone calls not only keep the lines of communication open, but they send a message to the employee that the employer is concerned about their wellbeing and recovery. In addition, insurance coverage issues and benefits can be addressed to avoid the claimant’s perceived need to seek a legal advocate.

This on going communication establishes that the employer is willing to go the extra distance for their employees, and in turn, the employee should be more receptive to return to work as soon as possible.

Early return to work saves workers compensation costs and the costs of hiring and training replacement workers. It improves your productivity and morale. Companies that have provided return to work opportunities have realized a 20%-40% savings in costs.

Studies show that the longer an injured worker remains out of work, the less likely he or she will return to legitimate, gainful employment.

The New York State Insurance Fund’s case management team offers professional support and direction in setting up a return to work program. Nurse and vocational case managers and loss control representatives are available to assist your organization in developing transitional work assignments and implementing your program.

There is additional information on establishing a return to work policy on the New York State Insurance Fund web site at www.nysif.com. If you have any questions, please call Eileen Preiato, Claims Supervisor at Friedlander Group, at 914-694-6000, ext. 227 or email Eileenp@friedlandergroup.com.

Business owner charged with Workers’ Comp. Fraud

An upstate New York motel owner will appear in Binghamton City Court later this month to answer several felony charges of workers' compensation fraud, the Press & Sun Bulletin newspaper reported.

Xiao Yun Lu, 44, of Union, N.Y., was

charged with three counts of offering a false instrument for filing and one count of fraudulent practices, all felonies, relating to violations of the Workers' Compensation Law, Broome County Sheriff's Detective Randall L. Gilbert told the newspaper.

According to the charges, Lu filed paperwork stating that she had no employees at her motel, the North Street Motor Lodge, but an investigation determined she actually had two workers at the business, the newspaper reported
