Underreporting payroll, Misclass-ification now felonies

 

A key provision of the new workers’ compensation reform law toughening the penalties for employers who cheat on

information used to calculate premiums went into effect on April 12.

            Employers who intentionally understate or conceal payroll or misrepresent the duties of employees to avoid proper classification are deemed to have not secured workers’ compensation coverage and are therefore subject to the same penalties as a business that does not have workers’ compensation coverage for its workers.

            For employers with more than five employees the crimes of

 

 

concealment or misrepresentation are now class E felonies with fines ranging from $5,000 to $50,000.

            For smaller employers, the first violation remains a misdemeanor carrying fines of $1,000 to $5,000.  Second offenses are felonies regardless of the number of employees.

            Under the new law, employers without coverage or who fail to pay penalties are considered a serious danger to public health and safety and the Workers’ Compensation Board is authorized to issue immediate stop-work orders.

            The law also bars companies from all public works projects for one year if found guilty of a misdemeanor.  In case of a felony conviction, offenders are barred for five years.  

 

Three Charged with Work. Comp. Fraud

 

New York State Insurance Fund CEO/Executive Director David P. Wehner recently announced three arrests for fraud against NYSIF. In one case both an employer and his employee were charged. 

            David Jacobson, the owner of Pat’s Pizzeria in the Erie County community of Farnham, was arrested May 2nd for lying about the work status of one of his employees.  Joseph Radosta had returned to work delivering pizzas following an injury.  Jacobson, however, provided false information during an audit claiming Radosta was still not working. 

           

            Meanwhile, Radosta, 47, of 228 Herkimer Street, Buffalo, testified at a hearing that he had not returned to work when in fact he had.  Radosta was also arrested Wednesday and charged with workers’ compensation fraud, perjury and insurance fraud. 

            Jacobson was also charged with insurance fraud as well as facing an additional charge of falsifying business records.

            In an unrelated case, Donald Bruyere, 29, of 558 Crescent Avenue, Buffalo, signed statements for the NYSIF that he had returned to work, but not when he said he did. In actuality, Bruyere had gone back to work prior to the date he attested to in his statement.  The dollar value of the fraud in this case is approximately $1,280.
